This is a new draft traffic law in Algeria

Parliament, in both chambers, announced the removal of the criminal character from the draft traffic law, and the reduction of fines for some violations, stressing the necessity of following a balanced legislative approach that combines deterrence and prevention to reduce traffic accidents.
According to a statement by the National People’s Assembly, the equal-member committee of the two chambers of Parliament, charged with proposing a consensus formula regarding the provisions in dispute between the two chambers in the text of the voted law containing the Traffic Law, held a meeting on the draft Traffic Law.
The level committee worked on addressing the provisions contained in Articles 104, 119, 121, 124, 125, 127, 128, 129, 161, 166 and 170, in line with the directions of the President of the Republic aimed at modernizing criminal policy by rationalizing the use of custodial penalties and devoting the principle of dual penalties, especially by removing the criminal character of some traffic violations and reviewing the penalty system in order to achieve a balance between the requirements of Deterrence and respect for rights and freedoms.
In this context, the members of the equal-member committee voted on the following articles: 104/119/166 and 170 by deleting the phrase “felonies,” while the amounts of fines for violations that have a kind of aggravation, included in Article 121, specifically those stipulated within the third and fourth categories, were reduced. As for the amounts of fines of the first and second degrees, they remained unchanged because they keep pace with the current economic and social circumstance, and this is in addition to deleting the phrase “Felonies” is from the title of this article.
The members of the committee also voted on Articles 125/127/128 and 129 by replacing the words “prison” and “temporary prison” with the words “imprisonment.” As for Article 124, they voted to delete the second paragraph related to the punishment imposed on transportation professionals, and to suffice with the first paragraph and generalize its provisions to vehicle drivers and transportation professionals alike.
The members of the equal-member committee stressed that removing the criminal character and reducing fines for some violations took into account the country’s alarming rise in traffic accidents and the huge human and material losses they cause, by following a balanced legislative approach that combines deterrence and prevention and enhances awareness-raising and training efforts and improving and developing road infrastructure.
