These are conditions for retirement before the legal age for education employees

Issue No. 6 of the Official Gazette was issued in Executive Decree No. 26-74 of January 14, which specifies the conditions and modalities for employees belonging to some branches of national education to benefit from a retirement pension before the legal age.

This decree aims to determine the conditions and modalities for employees belonging to the corps of teachers and professors of education, principals and directors of educational, instructional and inspection institutions, affiliated with the corps for national education, to benefit from the retirement pension before the legal age, in application of the provisions of Article 7 bis 1 of Law No. 83-12 dated 21 Ramadan 1403 corresponding to July 2, 1983, relating to amended and supplementary retirement.

Article 2 of the decree stipulates that an employee belonging to one of these corps can request to be referred for retirement, “starting at the age of 57 years for men and 52 years for women.”

Article 3 stressed that the employee must fulfill the legal conditions to benefit from the retirement pension and be in an active state when submitting the request for referral to retirement in accordance with the provisions of this decree. Article 4 also requires an employee wishing to benefit from a retirement pension before the legal age to “submit a dated and signed application with the institution in which he practices his work, within the first three months of the academic year.”

Article 5 stipulates that “the employing body cannot reject the request of the employee who wishes to be referred to retirement in accordance with the provisions of this decree,” while “the request of the employee who wishes to be referred to retirement must be kept in his administrative file.”

Employee pensions are liquidated – in accordance with the same decree – “in accordance with the provisions of Law No. 83-12 dated 21 Ramadan 1403 corresponding to July 2, 1983,” provided that “the pensions liquidated in accordance with the provisions of this decree will not be subject to review in the event that the employee resumes paid activity after being referred for retirement.”
