
On Saturday, the National People’s Assembly held a public session headed by the Speaker of the Council, Ibrahim Boghali, devoted to presenting and discussing the proposal to amend the Nationality Law.
During this session, the author of the proposal, Parliament member Hisham Safar, confirmed that the text aims to “adapt the legal framework regulating citizenship with the provisions of the Constitution and relevant international obligations, especially with regard to cases of deprivation of citizenship.”
In the same context, he highlighted that stripping Algerian nationality, whether original or acquired, “is not considered a general rule, but rather an exceptional legal procedure that is only resorted to in rare and established cases related to deliberate harm to the nation’s supreme interests or explicit repudiation of the duty of loyalty,” adding that the proposal “does not target the principle of dual nationality, but rather confronts cases of its misuse to evade responsibility or harm the security of the state.”
He continued that the proposal “specifies serious acts that require disqualification, such as compromising the security and unity of the state, showing loyalty to a foreign country while renouncing loyalty to Algeria, dealing with hostile parties, or engaging in terrorist or subversive groups or financing or propaganda for them, to the detriment of the interests of the state.”
When he intervened, the Minister of Justice, Keeper of the Seals, Lotfi Boudjemaa, confirmed that “after studying this proposal, the government found that it fulfills the procedural and formal conditions stipulated in the Constitution.”
He highlighted that the observations recorded by the government regarding this proposal “are mainly related to the need to strengthen its compatibility with the provisions of the Constitution, as well as with the applicable international mechanisms, which allow states to strip a person of his nationality, including original nationality as an exception and in specific cases, and these observations were taken care of according to the preliminary report for this law proposal that we reviewed.”
He also stressed the need to “strengthen the procedural guarantees that allow for the proper implementation of this proposal, especially the requirement that there be strong and consistent evidence that the person concerned has committed the dangerous acts stipulated in this law,” with “the person concerned must be notified in advance of the acts attributed to him.”
The Minister also indicated, “Assigning the process of studying and deciding on the files of stripping Algerian citizenship to a specialized, qualified body, and after studying the file and proposing stripping, it will be decided upon in the form of a presidential decree in accordance with the stipulated forms.”
