This evening, the Ministry of National Education issued an explanatory statement regarding the ministry’s invitation For unions The need to settle its legal status regarding assignments.
According to the statement, following the action taken by the Ministry of National Education through Education directorates It involves calling on all members of trade union organizations, whether at the national or state level, to regularize their legal status in accordance with what is stipulated in Law 23-02 regarding the exercise of the trade union right regarding assignment status.
The statement added that, after observing some incorrect interpretations and attempts to confuse public opinion about the truth of the matter, the Ministry of National Education clarifies the following: Law 23-02 issued on 04-25-2023 regulated the issue of “Mandate” in a clear and explicit manner in the text of Article 119 thereof, paragraph 03, which states the following: *(The secondment shall result in the suspension of the work relationship and the secondment’s wages shall be the responsibility of the concerned trade union organization)*.
The statement indicated that, given that the members of trade union organizations currently do not hold mandates in accordance with the law, nor do they carry out their original activity in their educational institutions in exchange for the wages they receive from the ministry.
The Ministry of National Education called on the unions to regularize their legal status only to protect them (because they are in an illegal status) and not to restrict them.
The Ministry of National Education confirmed that its invitation to members of trade union organizations to regularize their legal status is an invitation to them either to complete the procedures for assignments from their trade union organizations for their benefit, or to resume their original activity in their educational institutions.
The Ministry stated that this measure does not affect at all and does not affect the right to exercise union rights.
