Mohamed Bouderbala: Law 11-25 strengthens the fight against digital crimes with legal guarantees – Algerian Al-Hiwar newspaper

The head confirmed Algeria Judicial Council, Muhammad BouderbalaToday, Monday, Law 11-25 came to strengthen mechanisms for confronting cybercrime in light of the rapid development of digital technologies, while controlling them with precise legal guarantees that guarantee the protection of basic rights and freedoms.

This came during the opening of the training workshop entitled “Protection of personal data in light of Laws 07-18 and 11-25 between legislative developments and implementation stakes,” organized for the benefit of the Council’s judges, with the participation of judicial police officers and representatives. The National Authority for the Protection of Personal Datawithin the framework of the ongoing local training program.

Bouderbala explained that choosing this axis reflects institutional awareness of the importance of protecting personal data as an extension of protecting constitutional rights, especially those related to the sanctity of private life, confidentiality of correspondence, and the preservation of human dignity.

He pointed out that Law 07-18, amended and supplemented by Law 11-25, established for the first time an integrated legal framework for protecting data of a personal nature, by defining the concepts of processing and controlling the principles of legality, transparency, proportionality and purpose determination, while enshrining the rights of those concerned, such as the right to information, access, correction and objection.

He added that the rapid development of information systems and the growth of crimes associated with them obligated the legislator to strengthen the legal system, in order to achieve a precise balance between the effectiveness of combating digital crime and ensuring the basic rights of individuals.

The President of the Council stressed that the judicial authority is required to unify the judicial interpretation of the concepts of legitimate processing, and to devote effective oversight to the procedures for collecting digital data, while respecting the principle of proportionality and the legitimacy of licensing access to information systems or withholding data.

At the conclusion of the study day, Bouderbala expressed his hope that the workshop would lead to practical recommendations that could be implemented in the field, whether at the level of judicial organization or strengthening coordination with the national authority, in a way that responds to the challenges of the digital stage.
