Submitting a proposal for a new law related to retirement – New Algeria

Yesterday, Representative Youssef Ajissa from the Movement for Society for Peace deposited on the table of the National People’s Assembly office a proposal for a new law related to retirement without an age requirement, succeeding the first proposal that was deposited at the end of 2022.

The representative resorted to reducing the articles of the first proposal and deleting everything related to the financial impact On the state treasury, such as advance retirement for men and women, providing privileges to the Greater South, calculating 2.5 percent in the retirement grant for every year worked by a worker over 32 years of age, and even special privileges for workers with special needs, and being satisfied with only the retirement clause without the age requirement, which currently represents the demand of a large segment of workers.

The representative resorted to deleting these articles after directing an oral question to the Minister of Labour, Employment and Social Security about the capabilities of the Reserve Retirement Fund, which the representative views as constituting an important resource to cover potential additional expenses. Another oral question was asked to the Prime Minister two years ago about the decree on hard professions, but he has not answered it until now.

The representative attached to the proposed law a detailed memorandum of the proposal explaining the importance of the initiative and its impact, as well as objective justifications based on legal texts accompanied by a set of proposed alternatives regarding covering the financial difference in compliance with what was stipulated in Article 147 of the Constitution.

Among the alternatives presented by the representative: activating the exploitation of the resources of the Reserve Retirement Fund created in accordance with Order 06-04 containing the Supplementary Finance Law of 2006, amended and supplemented by Law 11-16 relating to the Finance Law of 2012, where among its income is 3 percent of the petroleum tax. The representative also proposed “investing the income of the Retirement Fund that has not been exploited since 2006, which represents a significant value that enriches us and refutes the proposition of China’s deficit.”Duke again.

The representative submitted another proposal to amend Executive Decree No. 15-236 dated 09-03-2015 specifying the percentages for distributing contributions to Social Security by raising the percentages allocated to the retirement fund within the framework of resetting the balance between the funds. He also proposed amending the decree specifying the funds’ contribution percentage currently estimated at 34.5 percent by adding 4 percent for the benefit of the retirement fund and distributing 2 percent equally to the employee and 2 percent to the worker, in addition to amending Article 60 of Law No. 22-24 dated no. 12-25-2022, which includes the Finance Law of 2023, which stipulates raising the 2 percent contribution applied to import customs duties on goods offered for consumption in Algeria to 3 percent.

The draft law, which “elhiwar us” has, proposes to benefit from a retirement pension upon fulfilling one of the following two conditions: reaching at least the age of sixty. However, a woman can be referred to retirement at her request starting from the full age of fifty-five years, and spending a period of at least thirty-two years at work. In return, workers who have spent more than thirty-two years of actual work and who have paid social security contributions will benefit from an increase in the pension of 2.5 percent for each year. Service, and the authors of the proposal suggested that workers in the Greater South benefit from a reduction in years of up to 5 years, and they also benefit from a reduction of up to 3 years from the end of their actual work in the South, and they also proposed that workers benefit from a reduction in the retirement age for the same period of time spent in national service.

Article 7 of the proposed law stipulates that workers who work in positions characterized by arduous working conditions will benefit from a pension when they reach the age of fifty-five for men and fifty-five for women, along with performing an actual period of work and paying contributions equivalent to at least twenty years. People with special needs can also benefit from retirement when they reach fifty.
