Official Gazette: Determining the early retirement age for education employees – New Algeria

Executive Decree No. 26-74 of Rajab 25, 1447, corresponding to January 14, 2026, was issued in the sixth issue of the Official Gazette, which specifies the conditions and modalities for employees belonging to some branches of national education to benefit from a retirement pension before the legal age.

This decree aims to determine the conditions and modalities for employees belonging to the corps of teachers and professors of education, principals, and directors of educational institutions, and inspections affiliated with the corps for national education, to benefit from the retirement pension, before the legal age, in implementation of the provisions of Article 7 bis 1 of Law No. 83-12 of July 2, 1983, relating to amended and supplementary retirement.

The second article of the decree in the Official Gazette stipulates that an employee, who belongs to one of the corps mentioned in the first article above, can request to be referred for retirement, starting at the age of fifty-seven (57) years for men and fifty-two (52) years for women.

The concerned person must fulfill all legal conditions to benefit from the retirement pension and in an active state, when submitting the application for referral to retirement in accordance with the provisions of this decree.

The employee, who wishes to benefit from the retirement pension starting from the age mentioned in Article 2 above, is also required to submit an application dated and signed by him, with the institution in which he practices his work, during the first three months of the academic year.

On the other hand, the employing body does not have the right to reject the request of the employee, who wishes to be referred to retirement, in accordance with the provisions of this decree, and the request of the employee, who wishes to be referred to retirement, must be kept in his administrative file, where the pensions of the employees concerned are settled, in accordance with the provisions of Law No. 83-12.

The liquidated pensions, in accordance with the provisions of this decree, are not subject to review in the event that the employee resumes remunerated activity after being referred for retirement.
