Hamas moves to amend the election law – New Algeria

The leadership of the Movement for Society for Peace (Hamas) commissioned the parliamentary group in the lower chamber to submit a draft amendment Election law According to the changes and developments produced by the past legislative and local elections, which revealed a number of gaps and imbalances.

The Society of Peace proposes deleting Clause 8 of Article 9 because, in its view, enabling candidates and parties to participate in the elections and revealing voter lists according to the scope of their distribution in the office, center, and municipality is an applicable constitutional right.

The articles related to the national card of the electoral body received great attention from the parliamentary group, as it was proposed to amend paragraph 3 of Article 52 to read: The conditions and methods for controlling and using the national card of the electoral body shall be determined in accordance with a decision approved by the Council of the Independent Authority. In the same context, it was proposed to add a new article. Related to the Electoral College, which stipulates that lists of voters be placed before citizens at the headquarters of the independent authority, the headquarters of municipalities or states, and the headquarters of Algerian diplomatic missions or consulates abroad, provided that these lists are published on the website of the independent authority or in any other way that ensures citizens’ information.

The Movement for Society for Peace proposes obligatory publishing the counting minutes of the voting offices on the website of the independent authority and enabling candidates to access freely and at any time before the final announcement of the results.

Another proposal raised by the movement is to amend Article 62. The amendment allows for the preparation of electoral lists and their periodic review or on the occasion of each electoral or referendum entitlement in each municipality by the municipal delegation of the independent authority to monitor elections.

As for the independent authority to monitor elections, the movement proposed amending Article 20 of the law. The amendment proposes raising the composition of the authority to 25 members elected from the judiciary, notaries, university professors, independent figures, and representatives of civil society, including two members from the Algerian community residing abroad.

The Peace Society proposed “amending Article 22,” and the amendment stipulates that it be held Independent Authority Council Periodically every month at the invitation of the head of the authority or at the request of two-thirds of its members, and it is held in an open session from the summoning of the electoral body until the announcement of the results, and provided that the first judge of the country appoints the Council of the Independent Authority elected from peers according to a presidential decree for a single term of six years, non-renewable. With the addition of a clause to Article 25, which stipulates the appointment of state and municipal delegations and diplomatic and consular representations abroad.

The Movement for Society for Peace (Hamas) views this step as a “priority,” as its president calls for “deepening the national dialogue between the authorities and the political formations so that fair and transparent presidential elections can be held.”

Regarding Hamas’s position on the upcoming presidential elections, our sources said: “The vision is not clear until the moment, and controversy is raging within the corridors of the movement between three scenarios, one of which tilts the balance towards the nomination of the movement’s leader, Hassani Sharif, according to what is often done in the event that it decides.” The political formation is running in the presidential race, which is the strongly proposed scenario. The second scenario suggests the candidacy of heavy figures within the movement, such as Abdel Razzaq Makri, who has previously expressed interest in this due date. The third scenario involves refraining from presenting a candidate for the presidential elections, which is the same scenario that the movement adopted in Elections on December 12.”

The Movement for Society for Peace (Hamas) is not the only one that has called for amending the electoral law, as many political formations have begun to fine-tune their proposals regarding amendments to the electoral law, and most of the proposed amendments will be related to the legislative elections.

Until the moment, it is not known whether the President of the Republic, Abdelmadjid Tebboune, will make a new amendment and thus refer the draft to Parliament in both chambers before the end of the parliamentary session to discuss it in the same way in which the rest of the draft laws are discussed, or whether a limited discussion will be resorted to, which is what happened with some draft laws such as The Investment Law and the Military Reserve Law, knowing that the annual recess of the legislative body in both chambers will begin on the second of next July.
