Officially…a positive drug test does not mean exclusion from employment – New Algeria

A new decree was issued requiring negative medical tests for drugs for employment in the public and private sectors, emphasizing that a positive test does not mean exclusion, but rather allows treatment and then candidacy for work.
The government introduced new regulatory amendments to the employment process in the public and private sectors, within the framework of tightening measures to prevent abuse of drugs and psychotropic substances within the work environment, according to An executive decree issued in Issue No. 08 of the Official Gazette made it mandatory for employment candidacy files to be accompanied by medical analyzes proving the absence of drug or psychotropic substance abuse, as a basic condition for studying candidates’ files.
This procedure, as stipulated in Article Four of the decree, includes all those wishing to occupy jobs or work positions within public departments, institutions and bodies, in addition to institutions of public benefit, institutions open to the public, as well as bodies and institutions affiliated with the private sector.
On the other hand, the legal text stressed that the results of medical tests are not considered an automatic reason for rejecting employment files or exclusion from professional examinations and competitions, whether in the public or private sector. The decree clarified that persons whose tests prove their abuse of drugs or psychotropic substances can run for employment, provided that they submit to the remedial and rehabilitation measures stipulated in Law No. 04-18 related to drug prevention and control.
In the same context, the decree obligated all relevant institutions and bodies to adapt their internal systems to the new provisions, within a period not exceeding six months starting from the date of publication of the text in the Official Gazette.
This ensures a unified and balanced application of this procedure at the national level.
