The Ministry of Education issued an explanatory statement regarding the Ministry’s call to unions to settle their legal status regarding assignments.
The statement stated, “Following the action taken by the Ministry of National Education through the education directorates, which was to call on all members of trade union organizations, whether at the national or state level, to the necessity of regularizing their legal status in accordance with what is required by Law 23-02 regarding the exercise of the trade union right regarding assignment status.”
The Ministry published clarifications stating that Law No. 23-02 issued on 04/25/2023 considers the issue of “secondment” in a clear and explicit manner in the text of its Article 119, Paragraph 03, which states the following: (The secondment shall result in the suspension of the work relationship and the secondment’s wages shall be the responsibility of the relevant trade union organization).
Given that the members of trade union organizations currently do not hold mandates in accordance with the law, nor do they carry out their original activity in their educational institutions in exchange for the wages they receive from the ministry.
Accordingly, the Ministry of National Education invited them to regularize their legal status only to protect them (because they are in an illegal situation) and not to restrict them.
The Ministry of National Education also confirmed that its invitation to members of trade union organizations to regularize their legal status is an invitation to them either to complete the procedures for assignments from their trade union organizations for their benefit, or to resume their original activity in their educational institutions.
It also stressed that this measure does not affect at all and does not affect the right to exercise union rights. Rather, the Ministry confirms that its doors are always open in accordance with what the law stipulates and that it is ready for permanent cooperation and coordination without violating the law.
